1. Acceptance of Terms

By accessing or using Practice Japanese ("Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

2. Description of Service

Practice Japanese is an online Japanese language learning platform that provides interactive tools and educational content. The Service is operated from Italy and is subject to Italian and European Union law.

3. Early Access Program

Premium features are currently in early access development. By subscribing to the premium plan, you acknowledge and agree that:

  • Premium features may contain bugs, errors, incomplete functionality, or unexpected behavior
  • Features may be modified, removed, or temporarily unavailable without prior notice as we continue development
  • The Service may experience downtime, performance issues, or data inconsistencies
  • Not all advertised features may be fully implemented or functional at the time of your subscription
  • We are actively developing and improving the platform, and your subscription helps support this ongoing development
  • You will not receive refunds for bugs, incomplete features, or service interruptions related to the early access nature of the premium tier

We appreciate your support during this early access period and welcome your feedback to help us improve the Service. You can report issues or provide feedback at support@practice-japanese.com.

4. User Accounts and Registration

To access certain features, you may need to create an account using email and password authentication. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and current information
  • Notifying us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

5. Subscription and Payment Terms

Practice Japanese offers a subscription service at $2.99 USD per month (or equivalent in your local currency). By subscribing, you agree to the following:

  • Billing: Subscriptions are billed on a recurring monthly basis through Stripe, our payment processor.
  • No Refunds: All subscription fees are non-refundable. We do not provide refunds or credits for partial subscription periods, bugs, incomplete features, or any issues related to the early access nature of premium features.
  • Cancellation: You may cancel your subscription at any time. Upon cancellation, you will retain access to premium features until the end of your current billing period. No refund will be issued for the remaining time.
  • Price Changes: We reserve the right to modify subscription prices with 30 days' notice. Continued use after price changes constitutes acceptance.
  • Account Deletion: If you delete your account, any active subscription will be immediately terminated without refund.

6. User Data and Content

The Service stores minimal data locally in your browser (learning progress, theme preferences). This data is stored on your device and will be deleted if you clear your browser data. We are not responsible for loss of locally stored data.

For users with accounts, we store only authentication information and subscription data as necessary to provide the Service.

7. Educational Content Disclaimer

Practice Japanese is provided for educational and informational purposes only. While we strive to provide accurate and up-to-date content, we make no representations or warranties of any kind, express or implied, about:

  • The completeness, accuracy, reliability, or suitability of any learning materials, translations, or exercises
  • The effectiveness of our methods for any particular individual or learning goal
  • The correctness of kanji readings, meanings, grammar explanations, or any other educational content

You acknowledge and agree that:

  • Educational content may contain errors, omissions, or inaccuracies
  • Our tools and materials should be used as supplementary learning aids and not as the sole source of Japanese language education
  • You should always verify information from multiple authoritative sources, especially for academic or professional purposes
  • We are not responsible for any consequences resulting from reliance on the information provided, including but not limited to exam failures, miscommunication, or professional setbacks
  • Language learning outcomes vary by individual, and we do not guarantee any specific results or level of proficiency

The Service is not a substitute for professional language instruction, academic courses, or official certification programs. For critical applications (business, legal, medical, academic examinations), always consult qualified professionals or official resources.

8. Acceptable Use Policy

You agree NOT to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to any portion of the Service
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Use any automated system, including robots or scrapers, to access the Service
  • Reverse engineer, decompile, or disassemble any portion of the Service
  • Remove, circumvent, or disable any security or technological features
  • Violate the intellectual property rights of Practice Japanese or any third party
  • Transmit viruses, malware, or other harmful code
  • Impersonate any person or entity or misrepresent your affiliation
  • Use the Service to harass, abuse, or harm another person or entity

9. Intellectual Property Rights

All content, features, functionality, tools, software, and materials on Practice Japanese, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, are the exclusive property of Practice Japanese or its licensors and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial educational purposes only.

10. Third-Party Services

The Service uses third-party services including Firebase (Google), Stripe, Google Analytics, and Google AdSense. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.

11. Advertising

The Service displays advertisements through Google AdSense. Advertisements are served by third-party vendors who may use cookies and web beacons to serve ads based on your prior visits to this website or other websites. You may opt out of personalized advertising by visiting Google Ads Settings.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. We make no warranties about the accuracy, completeness, or reliability of any content.

This disclaimer is especially applicable to premium features in early access, which may contain bugs, incomplete functionality, or temporary issues.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRACTICE JAPANESE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content
  • Any bugs, errors, incomplete features, or service interruptions related to early access premium features

IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR FIFTY EUROS (€50), WHICHEVER IS LESS.

14. Indemnification

You agree to indemnify, defend, and hold harmless Practice Japanese and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.

15. Service Modifications and Termination

We reserve the right to modify, suspend, or discontinue the Service or any part thereof at any time, with or without notice. We may also impose limits on certain features or restrict your access to parts or all of the Service without notice or liability.

This is especially applicable to early access premium features, which may be modified, removed, or temporarily unavailable as we continue development.

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Italy.

If you are a consumer resident in the European Union, you also benefit from mandatory provisions of consumer protection law in your country of residence.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Service with a new "Last Updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Practice Japanese regarding the Service and supersede all prior agreements.
